ARTICLE 1 - ORGANIZER AND CONTEST PERIOD

SOCIETE BIC société anonyme with share capital of €167,897,503.32, registered with the Nanterre Trade and Companies Register under number 552 008 443, whose registered office is located at: 12 Boulevard Victor Hugo, 92611 Clichy Cedex (hereinafter referred to as "BIC"), is organizing a prize draw with no obligation to purchase (hereinafter referred to as the "Contest").

Registration for the draw will be open until Friday, December 13, 2024.

Participation in this draw implies acceptance of these rules in their entirety and of BIC's decision on any dispute that may arise concerning the interpretation and application of these rules.

ARTICLE 2 - CONDITIONS OF PARTICIPATION

2.1 The prize draw is open to all public or private school teachers of cycle 1, 2 or 3, who are natural persons of legal age residing in mainland France and DROM-COM, who subscribe to the bickids.com newsletter, with the exception of employees of the various companies making up the BIC group and any entity directly or indirectly involved in the design, organization, production and/or management of the Contest, as well as their families (ascendants, descendants and spouses), (hereinafter the "Participant").

2.2 BIC reserves the right to ask any Participant to provide proof of these conditions.

Any person who does not meet the conditions indicated in these rules or who refuses to justify them will be excluded from the Contest and, in the event of winning, will not be entitled to the prize.

2.3 Any entry that is incomplete, does not comply with the conditions set out in these rules, is falsified, is late, or contains inaccurate or false information will not be taken into consideration and will be considered null and void.

2.4 BIC also reserves the right to exclude from the contest at any time and without notice, any person who adopts an unfair attitude with regard to this contest and its operation or who, through fraudulent behavior in any form whatsoever, interferes with the proper conduct of the contest.

ARTICLE 3: GAME MECHANISM

3.1 Participation in the draw is as follows:

- The teacher must complete the registration form for the Bic kids newsletter, in order to leave his/her contact details and school address so that he/she can be contacted if he/she is selected as one of the winners.

3.2 This draw is limited to one entry per person (same name, same postal address, same e-mail address).

ARTICLE 4: PRIZES AND DELIVERY OF PRIZES

4.1- The 100 winners of the prize draw will receive 1 pack x 10 Multi-surface pencils worth 19.50 euros.
One prize per participant.

4.2 The draw will be made by BIC.

4.3 Winners will receive an e-mail informing them of their prize within 4 days of December 16.

4.4 The prizes are nominative and will be sent to the winners at the school address given at the time of registration, within 8 days of the date on which the winner is informed of his/her win.

4.5 Any prize returned to BIC by mail or by the service provider in charge of transportation for any reason whatsoever will be considered abandoned by the winner.

4.6 The prize may not be awarded in any form other than that provided for in these rules.

No cash, goods or services will be exchanged for the prizes won.

4.7 BIC reserves the right, if circumstances so require, to substitute, at any time, the prizes with a prize of at least equivalent value without any claim being able to be made in this respect. BIC cannot be held responsible for any such substitution.

ARTICLE 5 - LIABILITY

5.1 BIC also declines all responsibility for errors in delivery, damage during transport, loss of prizes or the impossibility of contacting the winner in the event of an erroneous or incomplete address. In such cases, the carrier's responsibility must be sought directly by the winner, who will be responsible for this without recourse against BIC.

5.2 BIC cannot be held responsible for any incident that may occur during the enjoyment of the prizes, except in the event of the application of any applicable legal guarantees. BIC will not be held responsible if a winner is unable to use his/her prize.

5.3 In the event of exceptional circumstances, BIC reserves the right to interrupt, extend or shorten the contest or to modify the conditions of its organization. BIC may not be held liable in any such case.

5.4 BIC cannot be held responsible for any breakdowns, errors or computer viruses that may prevent continued access to the contest website, or for any malfunctions in users' computer systems that may occur following access to the contest website. BIC cannot be held responsible in the event of hacking or any other attack on its computer system, and the consequences that these may have for the user. In the event of a technical malfunction of the contest, BIC reserves the right to cancel the session during which the malfunction occurred.

ARTICLE 6 - PROTECTION OF PERSONAL DATA

6.1 In order to take part in the prize draw, Participants must provide certain personal information about themselves to Société BIC, which is responsible for processing this information, namely: e-mail address, first name, teacher's name, school address, postal code and town. The processing of this data is necessary to take entries into account, to determine the winners and to award and send the prizes.

6.2 This information is intended for BIC and its trusted service providers for the sole purpose of managing the contest. It will be recorded and saved in a computer file for a period necessary for the organization of the contest, in accordance with these rules.

Insofar as subscription to the BIC Newsletter is a condition of participation in the present prize draw, the data collected will be kept for the purpose of periodically sending out this newsletter. Participants consent to the processing and storage of their data for this purpose. Each newsletter contains an unsubscribe link.

6.3. You have the right (i) to access your personal data, (ii) to require that it be rectified, completed, updated, blocked or deleted, and (iii) to determine the fate of your personal data after your death and (iv) to ask us to send you a copy of your personal data in a commonly used and machine-readable format. We will consider such requests in accordance with applicable law and may also verify your identity in order to process such requests.

6.4 If you have any questions about the protection of your data or wish to assert your rights, please contact BIC's Data ProtectionOfficer:data-protection@bicworld.comBICmaymake changes, modifications and adaptations to the Creation as it deems appropriate, including, but not limited to, if necessary for technical purposes and/or for translation into the various languages in which the Creation will be reproduced or exploited. BIC reserves the right to adapt the Creation to its site (for equivalent products in its ranges).

ARTICLE 7 - REIMBURSEMENT

The costs incurred by participation in the competition are entirely the responsibility of the Participant, who may under no circumstances claim reimbursement from BIC.

ARTICLE 8 - COMPLAINTS

8.1 Any complaint concerning the contest must be made no later than (1) month after the deadline for participation in the contest, by simple letter addressed to BIC at the address indicated in Article 1 of these rules. This letter must indicate the exact date of participation in the contest, full contact details and the exact reason for the complaint. No other method of complaint will be accepted.

8.2 BIC has sole authority to rule on any question concerning the application or interpretation of these rules.

ARTICLE 9 - ACCEPTANCE OF THE RULES

9.1 Participation in the draw implies unreserved acceptance of the present rules in their entirety.

9.2 No tolerance in the application of the provisions of these rules may be interpreted as a waiver by BIC of its right to invoke them at a later date.

9.3 If one or more provisions of these rules are declared invalid or inapplicable, the other clauses will retain all their force and scope or may be replaced by a new valid provision.

ARTICLE 10- APPLICABLE LAW AND JURISDICTION

10.1 The present rules are governed by French law.

10.2 Any dispute arising in connection with this contest will be subject to an attempt at amicable settlement. If no agreement can be reached, the dispute will be submitted to the competent jurisdiction of BIC's head office, except in the case of public policy provisions to the contrary.
